I have just found out that Judge Stagg will allow the lesser included language instruction for the jury. In short, the defense will be able to argue that John Tuma was not actively involved and at worst he was negligent in not discovering the conduct of Cody Tuma, Wayne Mallet and Todd Cage. It could be interesting in the deliberation room.
