US v. John Emerson Tuma – Pre-Trial Continued . . .
Yesterday I blogged that the defense was seeking a continuance so that it could have more time to prepare its defense in light of the plea agreement by the defendant’s son, Cody Tuma. As was expected, the government opposed the motion. Today, the Court denied the motion for a continuance holding that: 1) the factual basis of the plea agreement with Cody Tuma was not a variance or an amendment of the original indictment; and 2) the plea agreement occurred two weeks ago and that the two weeks was sufficient amount of time to prepare.
Looks like the trial will proceed as scheduled on March 12, 2012.
