US v. John Emerson Tuma – Trial
The trial is scheduled to begin today at 9:00 a.m. with jury selection. It is anticipated that the jury will be seated and opening arguments will be completed before noon with the first witness being called right after lunch.
My good friend, Bruce Pasfield, with Alston & Bird, will be providing the comments on jury selection and the first day of trial. I will post them as soon as I receive them.
One little tidbit – there were some maneuverings this last week about Tuma’s attorneys wanting water samples from the facility to bolster its defense that on-site well water could not have been used to dilute waste water for disposal. The analysis of the on-site well water came back at almost drinking water quality. I anticipate that this particular line of defense will be out the window.
